Division of Property (“Equitable Distribution”)

West Palm Beach Divorce Lawyer / Family Law Attorney

In Florida law requires that the Courts distribute assets and debts fairly under the legal doctrine of equitable distribution. Equitable distribution requires that the Courts start with an equal division of property unless circumstances justify deviating and allocating an uneven distribution. As is the case in many areas of life the exception often swallows the rule and distributions and division of assets and debts are often not equal. The devil is in the details and the determinations as to equitable distribution are fact driven and depend on the facts of the case. The objective is to achieve fairness but that too is subjective. The determination is supposed to be guided by reference to a set of factors such as the income of each spouse, the lifestyle of each spouse during the marriage, the financial arrangements during the marriage and the divorce, as well as a host of other considerations. This area of the law is highly subjective which often means a divorce attorney may be needed to make sure the clients position and the facts of the case are known to the Court.
