In Florida law requires that the Courts distribute assets and debts fairly under the legal doctrine of equitable distribution. Equitable distribution requires that the Courts start with an equal division of property unless circumstances justify deviating and allocating an uneven distribution. As is the case in many areas of life the exception often swallows the rule and distributions and division of assets and debts are often not equal. The devil is in the details and the determinations as to equitable distribution are fact driven and depend on the facts of the case. The objective is to achieve fairness but that too is subjective.
